Bulleri Networks Terms And Conditions

Bulleri Networks welcomes you.  Bulleri Networks provides its service to you, subject to the following Terms and Conditions, which may be updated by us from time to time without notice to you.  When using our services, you shall be subject to any posted guidelines or rules applicable to such services that may be posted from time to time.  All such guidelines or rules are hereby incorporated by reference into these Terms and Conditions.

IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU SHOULD IMMEDIATELY STOP THE USE OF THE SERVICES AND NOTIFY THE BULLERI NETWORKS CUSTOMER SERVICE DEPARTMENT SO THAT YOUR ACCOUNT MAY BE CLOSED.


Your Account

You affirm that you are at least 18 years of age. As the account holder, you are responsible for your account and the maintenance of your password. You are responsible for all use of your account, by anyone, unless it can be conclusively proven, to the satisfaction of Bulleri Networks, to have been an unauthorized intrusion. If you believe that there has been unauthorized access to your account, you must change your password and notify Bulleri Networks immediately of the breach.

Payment

While Bulleri Networks provides its invoices through electronic methods. You agree to make the appropriate payment even absent an invoice or statement.

Prohibited Activities

You may not use the Service in a manner that violates any applicable local, state, federal or international law, order or regulation. Additionally, you may not use the Service to:  (a) conduct, participate in, or otherwise facilitate pyramid or other illegal soliciting schemes; (b) take part in any fraudulent activities, including, without limitation, impersonating any person or entity or forging anyone else's digital or manual signature; (c) invade another person's privacy, stalk, harass, or otherwise violate the rights of others; (d) post, transmit, or disseminate content that is threatening, abusive, libelous, slanderous, defamatory, incites hatred, or is otherwise offensive or objectionable; (e) restrict, inhibit, or otherwise interfere with the ability of any other person to use or enjoy the equipment or the Service, including, without limitation, by posting or transmitting any information or software that contains a virus, lock, key, bomb, worm, Trojan horse, cancelbot, or other harmful feature; (f) collect or store personal data about other users; (g) use an IP address not assigned to you; (h) violate any other Bulleri Networks policy or guideline; (i) resell or redistribute the Service to any third party via any means, including, but not limited to, wireless technology; or (j) harm or attempt to harm a minor, including, but not limited to, by hosting, possessing, disseminating, or transmitting material that is unlawful, including child pornography or obscene material. 

Intellectual Property Infringement

You may not use the Service to post, copy, transmit, or disseminate any content that infringes the patents, copyrights, trade secrets, trademark, or propriety or other intellectual property rights of any party. Bulleri Networks assumes no responsibility, and you assume all risks regarding the determination of whether material is in the public domain, or may otherwise be used by you for such purposes. 

Hardware

Bulleri Networks cannot guarantee that all current or future Internet applications can or will be supported. Neither will Bulleri Networks guarantee that any subscriber equipment will be compatible with our service, nor that all areas within our coverage area will produce a usable connection. Bulleri Networks is not responsible for any inability to use our service for any reason.
 
Bulleri Networks is not responsible for any damage to or loss of data or software from your computer while installing, operating or maintaining Bulleri Networks services. We recommend that you back-up all existing computer files by copying them to a different storage device prior to the installation, operation or maintenance of any Bulleri Networks hardware or software.

Indemnity

You agree to indemnify and hold harmless Bulleri Networks, affiliate corporations, all of their officers, directors, agents, employees and shareholders, for, from and against all claims, damages, costs and expenses, including, without limitation, legal fees and costs, that arise out of, relate to, or result from the use, by anyone, of your Bulleri Networks account, without limitation.

Compliance Measures

Bulleri Networks reserves the right to monitor any and all communications and activity through or with the Bulleri Networks service to ensure adherence to the terms and conditions of this Agreement.

You agree that the Bulleri Networks Internet service is not to be considered a secure communications medium and that no expectation of privacy is afforded to you or any user of your account.

In the event that Bulleri Networks receives a complaint, Bulleri Networks will investigate the complaint and, in its sole and absolute discretion, may suspend or terminate the account(s) involved and/or may remove any material from its servers.  Customers may or may not be notified of this proceeding.  Bulleri Networks reserves the right to release customer information to comply with an investigation into any activity that may violate these terms, and may report such activities to the appropriate authorities.

Bulleri Networks reserves the right to prohibit, remove and/or block access to any content or Internet capability, including any pages, Usenet newsgroup and/or IRC channel, peer to peer programs, Instant Messaging session, peer to peer exchange, or Voice over IP, at any time for any reason, including but not limited to those which contain:  hyperlinks to material Bulleri Networks deems inappropriate; or material that promotes or induces illegal activity.

Termination

Bulleri Networks may suspend or restrict your account and the Bulleri Networks service or terminate this Agreement, at any time, if:

  • the operations or efficiency of the Bulleri Networks service is impaired by the use of the Bulleri Networks service from your account;
  • any owing amount is past due from you to Bulleri Networks;
  • you or anyone contacting Bulleri Networks as your agent or on your behalf engages in any denigrating, abusive or threatening manner; or
  • there has been or is any breach of any term or condition of this Agreement.

If services are terminated you remain responsible for payment of all fees up to the conclusion of any term you have contracted for or prepaid. If your use has extended beyond the sign up term, then you will be responsible for payment for service through the conclusion of the month during which service is terminated. Bulleri Networks shall have no responsibility to notify anyone of any termination or suspension of an account. Any termination of this Agreement shall not relieve you from any amounts owing or other liability accruing hereunder prior to the time that such termination becomes effective.

User Content

You are solely responsible for any information that you publish on the web or other Internet services. You must ensure that the recipient of the content is appropriate and must take appropriate precautions to prevent minors from receiving inappropriate content.  Bulleri Networks reserves the right to refuse to post or to remove any information or materials from the Service, in whole or in part, that it, in Bulleri Network’s sole and absolute discretion, deems to be offensive, indecent, or otherwise objectionable. 

Commercial Use

The Service is designed for personal use of the Internet and may not be used for commercial purposes. You may not charge others to use the residential Service. You agree not to use the Service for operation as an Internet service provider, or for any other business enterprise, including, without limitation, IP address translation or similar facilities intended to provide additional access. 
Servers.  You may not operate, or allow others to operate, servers of any type or any other device, equipment, and/or software providing server-like functionality in connection with the Service, unless expressly authorized by Bulleri Networks. 

Misuse of Service

You are responsible for any misuse of the Service that occurs through your account. You must therefore take steps to ensure that others do not gain unauthorized access or misuse the Service. 

 Hacking/Attempted Unauthorized Access

You may not use the Service to breach or attempt to breach the security of another user or attempt to gain access to any other person's computer, software, or data without the knowledge and consent of such person. The equipment and the Service may not be used in any attempt to circumvent the user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks or computers for any reason. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools, is prohibited. 

Security

You are solely responsible for the security of any device connected to the Service, including, without limitation, any data stored on that device. Bulleri Networks recommends that you take appropriate security precautions for any systems connected to the Service.

Disruption of Service

You may not disrupt the Service in any manner. Nor shall you interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges or attempts to "crash" a host. 

Viruses, Trojan Horses, Worms and Denial of Service Attacks

Software or other content downloaded from the Service may contain viruses and it is your sole responsibility to take appropriate precautions to protect your computer from damage to its software, files and data. You are prohibited from posting, transmitting or disseminating any information or software that contains a virus, Trojan horse, worm or other harmful program or that generates levels of traffic sufficient to impede others' ability to send or retrieve information. Prohibited conduct of this type includes denial of service attacks or similarly disruptive transmissions, as well as transmissions containing other harmful or malicious features.

Electronic Mail

You may not use the Service to send unsolicited bulk or commercial e-mail messages ("spam"). Any unsolicited e-mail must also not direct the recipient to any web site or other resource that uses the Service. The Service may not be used to collect responses from unsolicited e-mail sent from accounts on other Internet hosts or e-mail services that violates this Policy or the acceptable use policy of any other Internet service provider. In addition, "mail bombing," the sending of numerous copies of the same or substantially similar messages or very large messages or files with the intent to disrupt a server or account, is prohibited. You may not reference Bulleri Networks, Bulleri Networks or any portion of the Bulleri Networks network (e.g. by including "Organization: Bulleri Networks" in the header or by listing an IP address that belongs to the Bulleri Networks network) in any unsolicited email even if that email is not sent through the Bulleri Networks network. Further, forging, altering or removing electronic mail headers is prohibited. 

Bandwidth, Data Storage and Other Limitations

Bulleri Networks offers multiple packages of Service with varying speeds and features and bandwidth usage limitations (not all packages are available in all areas). You must comply with the current bandwidth, data storage and other Limitations of Service that correspond with the package of Service you selected. In addition to complying with the limitations for specific features, you must ensure that your activities do not improperly restrict, inhibit, or degrade any other user's use of the Service, nor represent (in Bulleri Network's sole judgment) an unusually great burden on the network itself. In addition, you must ensure that your use does not improperly restrict, inhibit, disrupt, degrade or impede Bulleri Network's ability to deliver the Service and monitor the Service, backbone, network nodes, and/or other network services. If you use excessive bandwidth (as determined by Bulleri Networks), Bulleri Networks may terminate, suspend, or require you to upgrade the Service and pay additional fees.

BULLERI NETWORKS WEB SITE PRIVACY POLICY

BULLERI NETWORKS, LLC, an Arizona limited liability company (“us,” “we” or “our”) created this Bulleri Web Site Privacy Policy (“Privacy Policy”) in order to ensure the confidence of visitors and customers (“you” or “your”) of and to our Web site (the “Site”) and to demonstrate our commitment to fair information practices and the protection of privacy.

Types of Information Collected

    •  Policy.  It is our policy to collect only the information that we need to provide the services of this Site while still providing you with the quality and level of service that you desire. 
      1. Traffic Data Collected.  If you are a visitor to this Site, we automatically track and collect the following information when you visit our Site, including, without limitation, your: (i) IP address; (ii) domain server; (iii) type of computer; and (iv) type of web browser (collectively “Traffic Data”).  Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site.  We also use “cookies” to customize content specific to your interests, to ensure that you do not see the same advertisement repeatedly and to store your password so you do not have to re-enter it each time you visit the Site.
      2. Personal Information Collected.  If you are a customer of this Site, we require you to provide us with information that personally identifies you (“Personal Information”).  Personal Information may include, without limitation: (i) Contact Data (such as your name, mailing and e-mail addresses); or (ii) Demographic Data (such as your zip code, age and income).  If you communicate with us by e-mail, post messages to any of our chat groups, bulletin boards or forums, or otherwise complete online forms, surveys or contest entries, any information provided in such communication may be collected as Personal Information.  In addition, although we may collect Financial Data (such as your credit card information) for purposes of facilitating a transaction on our Site, we do not store any Financial Data on our server.  Further, it is our policy to only retain all Personal Information only as long as needed for our business purpose or as law may require.
    • Uses of Information Collected
      1. We consider any Personal Information to be confidential, and it is our policy to use it only to in providing our services, including operations, administration, marketing, customer support, protection from fraud and abuse and in any other way related to our services.  We use Contact Data to send you information about our company or our products or services, or promotional material from some of our partners, or to contact you when necessary.  We use your Financial Data to verify your qualifications for certain products or services and to facilitate online payment for those products or services.  We use your Demographic Data on an aggregate basis to customize and tailor your experience on the Site, displaying content that we think you might be interested in and according to your preferences.
    • Sharing of Personal Information
      1. It is our policy not to Contact Data with any third parties. 
    • User Choice Regarding Collection, Use and Distribution of Personal Information 
      1. You may choose not to provide us with any Personal Information.  In such an event, you can still access and use much of the Site; however you will not be able to access and use those portions of the Site that require your Personal Information.  If you do not wish to receive information and promotional material from us, you may select the appropriate “opt-out” option each time we ask you for Personal Information.
    •  Confidentiality and Security of Personal Information
      1.  Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; (b) protect our rights or property; or (c) enforce our Terms of Service.  Your Personal Information is stored on secure servers that are not accessible by third parties.  We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser.  
    • Lost or Stolen Information 
      1. You must promptly notify us if your credit card, user name or password is lost, stolen or used without permission.  In such an event, we will cancel that user name or password and update our records accordingly.
    • Other Limits to Your Privacy 
      1. The Site contains links to other Web sites.  We are not responsible for the privacy practices or the content of such Web sites.  We may make chat rooms, forums, message boards, and news groups available to you.  Please understand that any information that is disclosed in these areas becomes public information. We have no control over its use and you should exercise caution when deciding to disclose your Personal Information.
    •  Children’s Privacy 
      1. We are committed to protecting the privacy of children.  You should be aware that this Site is not intended or designed to attract children under the age of 13.  We do not collect personally identifiable information from any person we actually know is a child under the age of 13.  A parent or guardian, however, may use the Site to establish an account for a minor.  The parent or guardian assumes full responsibility for ensuring that the registration information is kept secure, supervising a minor’s use of the Site and guaranteeing that the information submitted is accurate.
    •  Updates and Changes to Privacy Policy 
      1. We reserve the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on the Site.  Any such change, update or modification will be effective immediately upon posting on the Site.


    SERVICE AGREEMENT

    BACKGROUND:

    The Customer is of the opinion that the Service Provider has the necessary qualifications, experience and abilities to provide services to the Customer. The Service Provider is agreeable to providing such services to the Customer, on the terms and conditions as set out in this Agreement.

    AGREEMENT


    IN CONSIDERATION OF

    the matters described above and of the mutual benefits and obligations set forth in this Agreement, the receipt and sufficiency of which consideration is hereby acknowledged, the parties to this Agreement agree as follows:

    Engagement

    The Customer hereby agrees to engage the Service Provider to provide the Customer with services consisting of Wireless Internet Service and such other services as the Customer and the Service Provider may agree upon from time to time, and the Service Provider hereby agrees to provide the Services to the Customer.

    Term of Agreement

    The term of this Agreement will begin on the date of this Agreement and will remain in full force and effect for a period of 1 month, with the term being capable of extension by mutual written agreement of the parties.

    Performance

    The Service Provider will provide the Service in a reasonable and workmanlike manner. The Customer shall provide Service Provider access to all locations for antenna installation.

    Compensation

    The Customer will compensate the Service Provider monthly upon receipt of Bulleri Network’s invoice. If the Customer chooses to compensate the Service Provider by check and the check is found to have non-sufficient funds, the Customer will be charged $25.00.

    The Customer shall be responsible for any and all taxes, levies or other charges by any governmental authority on any provision of the Services. The Service Provider is authorized to include any such amount on any and all invoices sent responsible for paying such amounts.

    Additional Compensation

    The Service Provider acknowledges that compensation as provided for in this Agreement constitutes full monetary compensation for the Services performed. Accordingly, there will be no additional compensation.

    Expenses

    The Service Provider will be reimbursed for any expenses incurred in connection with providing the Services hereunder. The compensation provided is done so in contemplation of any and all expenses that may be incurred by the Service Provider.

    Enurement

    Subject to Section 9, this Agreement will enure to the benefit of and be binding upon the respective successors and assigns of the parties.

    Titles/Headings

    Headings are inserted for the convenience of the parties only and are not to be considered when interpreting this Agreement.

    Assignment

    Customer shall not be permitted to assign, transfer or convey all or any portion of this Agreement without the express written approval of Service Provider. Any attempted assignment in contravention hereof shall be null and void.

    Capacity/Independent Contractor

    It is expressly agreed that the Service Provider is acting as an independent contractor and not as an employee in providing the Services hereunder. The Service Provider and the Customer acknowledge that this Agreement does not create a partnership or joint venture between them.

    Modification of Agreement

    Any amendment or modification of this Agreement or additional obligation assumed by either party in connection with this Agreement will only be binding if evidenced in writing signed by each party or an authorized representative of each party.

    Entire Agreement

    It is agreed that there is no representation, warranty, collateral agreement or condition affecting this Agreement except as expressed in it.

    Counterparts

    This Agreement may be executed in one or more counterparts, each of which will be deemed to be an original and together will constitute one and the same instrument.

    Confidentiality

    This Agreement and the performance of the Services shall be maintained by the Customer as confidential and the Customer shall not disclose such information without the express written consent of the Service Provider.

    Limitation of Liability

    THE MAXIMUM AGGREGATE LIABILITY OF THE SERVICE PROVIDER TO THE CUSTOMER HEREUNDER SHALL BE THE TOTAL AMOUNT OF COMPENSATION ACTUALLY PAID TO THE SERVICE PROVIDER HEREUNDER DURING THE PRECEDING TWELVE MONTH PERIOD.

    Indemnification

    The Customer shall indemnify and hold the Service Provider and its members, manager, officer, agents, and attorneys harmless for, from and against any and all liabilities, harm, damages, lawsuits, proceedings, costs and fees (including, without limitation, attorneys’ fees and costs) arising out of or related to this Agreement, any breach of this Agreement by Customer or any claims of any party related to the Service Provider’s performance of its obligations hereunder.
